Benefit Plan Disclosures

ChicagoWayWorkforce is not an insurance provider, broker, or underwriter. Access to benefit plans is provided as part of co-employment services, and participation in any such plan is entirely voluntary.
All plan terms, eligibility rules, benefits, and limitations are governed exclusively by the official plan documents and carrier-issued certificates. Any summary descriptions—whether written, electronic, or verbal—provided via the ChicagoWayWorkforce platform are offered solely for convenience and do not amend, supplement, or override the binding terms of the governing legal documents.
Plan availability, carrier selection, and coverage terms are subject to change at any time without prior notice. All inquiries, claims, appeals, or coverage-related disputes must be directed to the relevant insurance carrier or benefit administrator, in accordance with the procedures outlined in the official policy or certificate of coverage.
Employer and Client Responsibility
Clients of ChicagoWayWorkforce are not considered plan sponsors or fiduciaries of any benefit programs offered under the PEO arrangement. Employment & Employer Services, Inc. assumes all administrative and legal obligations related to the design, sponsorship, compliance, and maintenance of its benefit offerings.
Insurance carriers have no contractual or fiduciary relationship with client companies outside of their binding agreement with Employment & Employer Services, Inc. Accordingly, all liabilities, obligations, and plan compliance responsibilities rest solely with the PEO.
Language referring to “your employees,” “your workforce,” or “your benefits” throughout this site and in related communications is used strictly for colloquial convenience and does not imply ownership, sponsorship, or legal control by the client over the co-employed individuals or the benefit programs in question.
Employers are encouraged to consult with their own independent legal, tax, or compliance advisors to assess any obligations that may arise outside the scope of the PEO relationship, including under applicable state or federal laws such as the ACA, ERISA, or COBRA.
Controlling Documentation
In the event of any conflict or inconsistency between information provided through ChicagoWayWorkforce.com and the terms contained in official plan documentation or insurance certificates, the official documents shall govern and prevail.
